(Commercial Law), MCI(Arb) Bencher of the Inner Temple Called to the Bar – 1983 Appointed Queen’s Counsel – 2009 Mark is a highly experienced, versatile and persuasive advocate who is recognised as a leader in several fields of complex law. As a jury advocate, Mark is a high-profile leader in the fields of murder and manslaughter cases, especially those involving young defendants. Many of his cases have been the subject of BBC dramatisations or front-page news. Trained as a commercial Barrister and Arbitrator he has specialisms in international commercial arbitration and in intellectual property law in addition to High Court work. Mark is also recognised as a leader in the area of consumer law and fraud prosecuting and defending in the most important Trading Standards and intellectual property fraud-related cases. Examples of leading Murder/Manslaughter cases 2017 saw Mark defending in the very high profile ‘bike boy’ case [R –v- X] at the Central Criminal Court (‘Old Bailey’) in which he secured an acquittal for manslaughter for his client and as a result of which case the law in this area went under Government Review and was ultimately reformed recently. Mark was a consultee on that Government review and was interviewed extensively in the media concerning the legal issues in the aftermath of the verdict including several with the BBC and Sky News. 2018 saw Mark defending in R v X &amp; others – one of the first ‘County Lines’ inter-drug gang murders. This case included detailed submissions concerning the admissibility of ‘drill rap’ evidence and other strands of prosecution material. 2019 – ‘The Responsible Child’ broadcast – a BBC dramatisation about a real murder trial in which Mark defended a 14-year-old boy charged with murder. Mark secured his client’s acquittal of murder. Mark declined to be interviewed about the case by mainstream media save for one article in one of the quality newspapers. 2020 – The ‘Covid 19’ case. Mark appeared as lead counsel for the defence in a lengthy multi-defendant murder trial before the Central Criminal Court. This case started before the pandemic caused the suspension of nearly all criminal trials. The case was resumed after a month’s break but with stringent measures to safeguard all participants in the trial process including Court staff. The case was successfully concluded in a fair and proper manner. Mark’s client was acquitted of all charges. Numerous members of WTC appeared in this case and aided not only their clients but contributed positively to the process helping form future policy and practical guidance for all future trials threatened by the pandemic. Examples of high-profile High Court civil work and arbitrations Mark is a recognised Trade Mark Counsel and from 2014 to 2017 represented Peter Hook, bass player with Joy Division and New Order, in a successful derivative claim in the Chancery Division against the other members of New Order. 2019 – Mark appears for the respondent in a multi-million dollar international commercial arbitration involving mineral licenses in Africa.   Examples of leading Trading Standards cases 2017 - Mark secured the acquittal of the client he represented in the high-profile prosecution ‘Operation Cleo’ – an NTSC case involving alleged multi-million-pound fraud on the Revenue via alleged ‘look alike’ websites. 2020 – Mark prosecuted ‘Operation Gleam’ for Trading Standards imprisoning a gang manufacturing and selling dangerous and adulterated teeth whitening toothpaste in a country-wide fraud detected at the Royal Welsh Show. This case became the subject of a recently broadcast BBC documentary.       <image:caption>Jo is the embodiment of excellence and experience. Jo has a long and close association with the law. Jo started out as the Assistant Secretary to the Clerk of the Justices at Bedford Magistrates Court in 1985. In 1986 Jo joined the newly created CPS. Jo’s interactions with various chambers soon lead to an offer of her first clerking position with a barristers’ chambers in 1987. Jo’s first appointment as a Senior Clerk took place at the Chambers of Stuart Cakebread Q.C. – a position obtained at a remarkably young age. That set was a common law set. In April 1996 Jo was appointed as Senior Clerk at 2 Paper Buildings, a set founded by Mark Wyeth.  As Senior Clerk in this Common Law set Jo excelled in her post. Working closely with Mark and with a team of three other good clerks they oversaw the expansion and significant increase in turnover of chambers. Jo’s abilities and success got her noticed. It is also fair to observe that it got the barristers noticed too. It is remarkable to observe that from the ranks of that chambers that Jo helped so much, no fewer than four Q.C.’s and four Judges were to be appointed in future years. In 1999 Jo was approached by the much bigger Furnival Chambers to join as a clerk. The ensuing move now meant Jo was to clerk a young Charles Sherrard amongst many others. Once again Jo created a very favourable impression with her diligence and skill. An impression that lasted long in the memory. Having completed a degree in Government at the then City of Birmingham Polytechnic it soon became apparent that there were no immediate vacancies for him at the foreign desks of any of Fleet Street broadsheets and a career re-think was quickly needed. An impassioned plea to the Course Leader of the Common Professional Examination in Law conversion allowed Dale to embark upon a career in the field of law. Kim served as Director of Public Prosecutions (DPP) of the British Virgin Islands (BVI ) for 4 years managing a government department as well as having sole responsibility for all Prosecutions. She advised at the highest Government / Cabinet / National Security Council level on Security and Human Rights in addition to regularly liaising with the United States Virgin Islands in relation to mutual cooperation and extradition. Whilst in office she prosecuted complex serious drug and money laundering-related multiple murder trials as well as sexual offences to Privy Council level. She is a recognised expert in Confiscation and the Beneficial Ownership Register of Virgin Islands as well as preparing her department for the FATF 40 evaluation which was due to be carried out in 2017. She played a pivotal role in re-establishing the Criminal Justice System of BVI following the devastation of the 2017 Hurricanes, including personally taking through the House of Assembly video link and anonymity legislation. In addition, she contributed to drafting the Criminal Procedure Rules and Sentencing Guidelines for the Territory and OECS. Kim has advised the UK Foreign and Commonwealth Office since 2013 as a member of their Diplomatic Excellence Panel and was specifically commissioned to conduct a root and branch review of Criminal Justice System of British Virgin Islands with recommendations for reform on her return to the UK in 2020. She is an Expert in Criminal Justice practice and procedure throughout the Caribbean and is called to the Bar in Bermuda and Belize where she has defended in high profile cases including Human Trafficking, Sexual Offences and Murders. Kim was the First female Asian Queens Counsel of the UK. (2002) and is a Master of the Bench of Gray’s Inn (2008), an Accredited Advocacy Trainer (2003) and was Appointed to the list of Approved counsel at the International Criminal Court (2013). In 2022, Kim successfully advised a challenge to the Mutual Legal Assistance Procedure on failure to comply with a notice to produce information issued by the International Tax Authority of the British Virgin Islands based on her in-depth knowledge within the jurisdiction. In 2024, Kim has been deemed an expert witness by a United States Court in relation to United Kingdom and British Virgin Island Bribery and Corruption Law to assist a Miami Judge in the courts’ legal instructions to a jury.</image:caption>

(Commercial Law), MCI(Arb) Bencher of the Inner Temple Called to the Bar – 1983 Appointed Queen’s Counsel – 2009 Mark is a highly experienced, versatile and persuasive advocate who is recognised as a leader in several fields of complex law. As a jury advocate, Mark is a high-profile leader in the fields of murder and manslaughter cases, especially those involving young defendants. Many of his cases have been the subject of BBC dramatisations or front-page news. Trained as a commercial Barrister and Arbitrator he has specialisms in international commercial arbitration and in intellectual property law in addition to High Court work. Mark is also recognised as a leader in the area of consumer law and fraud prosecuting and defending in the most important Trading Standards and intellectual property fraud-related cases. Examples of leading Murder/Manslaughter cases 2017 saw Mark defending in the very high profile ‘bike boy’ case [R –v- X] at the Central Criminal Court (‘Old Bailey’) in which he secured an acquittal for manslaughter for his client and as a result of which case the law in this area went under Government Review and was ultimately reformed recently. Mark was a consultee on that Government review and was interviewed extensively in the media concerning the legal issues in the aftermath of the verdict including several with the BBC and Sky News. 2018 saw Mark defending in R v X &amp; others – one of the first ‘County Lines’ inter-drug gang murders. This case included detailed submissions concerning the admissibility of ‘drill rap’ evidence and other strands of prosecution material. 2019 – ‘The Responsible Child’ broadcast – a BBC dramatisation about a real murder trial in which Mark defended a 14-year-old boy charged with murder. Mark secured his client’s acquittal of murder. Mark declined to be interviewed about the case by mainstream media save for one article in one of the quality newspapers. 2020 – The ‘Covid 19’ case. Mark appeared as lead counsel for the defence in a lengthy multi-defendant murder trial before the Central Criminal Court. This case started before the pandemic caused the suspension of nearly all criminal trials. The case was resumed after a month’s break but with stringent measures to safeguard all participants in the trial process including Court staff. The case was successfully concluded in a fair and proper manner. Mark’s client was acquitted of all charges. Numerous members of WTC appeared in this case and aided not only their clients but contributed positively to the process helping form future policy and practical guidance for all future trials threatened by the pandemic. Examples of high-profile High Court civil work and arbitrations Mark is a recognised Trade Mark Counsel and from 2014 to 2017 represented Peter Hook, bass player with Joy Division and New Order, in a successful derivative claim in the Chancery Division against the other members of New Order. 2019 – Mark appears for the respondent in a multi-million dollar international commercial arbitration involving mineral licenses in Africa.   Examples of leading Trading Standards cases 2017 - Mark secured the acquittal of the client he represented in the high-profile prosecution ‘Operation Cleo’ – an NTSC case involving alleged multi-million-pound fraud on the Revenue via alleged ‘look alike’ websites. 2020 – Mark prosecuted ‘Operation Gleam’ for Trading Standards imprisoning a gang manufacturing and selling dangerous and adulterated teeth whitening toothpaste in a country-wide fraud detected at the Royal Welsh Show. This case became the subject of a recently broadcast BBC documentary.
